Overhanging Nuisance Trees

Can anyone give advice about how we stand regarding neighbours overhanging trees which are a nuisance to our property and pool. Can we trim them? Can we get them removed? :? :? :?

Think air superiority, draw a vertical border around your property and anything that hangs over can be trimmed.

We have the same problem and have removed the overhanging branches, but what about shade ?

We are about to "trim" overhanging trees from our next door neighbour, they are a bloomin nuisance. Although they look beautiful, they are the ones that have lovely red flowering hanging down, similar to Lupins? But they SO attract buzzy bees and nasty waspys that they are a pain! and the red spindly bits from the flowers go all over the place and in the pool. Off with their heads I say!

You can appeal to the good nature of your neighbour and ask them to trim or remove the trees, but technically you cannot do anything against someones garden growth as long as it stays within their borders. Lots of houses once had a seaview which has now disappeared behind shrubs, palms, pines and cyprus trees, that is just the way it goes.

I am not 100% on what happens when roots start doing undergound damage, but I am pretty sure you can dig them up and cut them.

UK law stipulates the following ; A neighbours house and land etc one must not detract from air and light to another property. You might get somewhere re that point. Re overhanging trees bushes etc onto a neighbours property. You may remove overhanging bits in your property and you have to put it back in your neighbours property.So all the bits floating around in your pool, property, land etc bag it all up and deposit on your neighbours site. Tell them its theres and they have to dispose of it. As it is not your property it belongs to them. Re root removal,it may or may not cause a problem to your adjoining property, land etc. It depends on the offending tree(s) or shrub(s). You must get in a proffessional tree surgeon or tree specialist who can conduct a survey and ascertain root structure/ bowling etc of the offending growth. Some trees are best left cut down and pruned on a regular basis rather than removing root structure as it may cause more structural damage to properties. Insurance companies need to be notified from both parties.

Good story,we could face a similar problem, we asked our portuguese neighbours if they thought we would have any problems trimming the Pines on our boundary.

Sharp intake of breath " he is not a nice man " they replied referring to the neighbouring land owner suggesting that we do as much as we can on our side and hope that he doesn,t notice.

at least he hasn,t got dogs or cockerels
