Power of Attorney

Hi all

We are in the process of buying a villa in Carvoeiro. Our solicitor has told us we need to now get authorisation from the Portuguese Embassy to give him the power of attorney to tie things up in Portugal (apply for the habitation licence etc.). Trying to get info from the Embassy is proving difficult as nobody seems to want to know.

Does anyone else know a way around this without going to Portugal as it is now holding us up?

Hello Paul,

I experienced the very same problem when purchasing in Cvo a couple of years back. What I did was pay the Portuguese consulate in London a visit duly armed with passport various pieces of other ID and a pro forma document from my Portugues lawyer giving the precise wording required.

Where are you based? Can you get into London easy? The consultae is just opposite Harrods. You will have to get there early - it is first come first served, and be prepared to sit around for a few hours. The notary will take your pro forma , re type it on Consulate paper, stamp it and ask for a small sum - £15- 20. Best bet then is to courier it to your lawyer in Portugal. It certainly worked for us and saved me a rather expensive day trip to Portugal. If you want to leave a mail address and I will dig out and send you the pro forma and other bits and pieces I have on the subject.

Hi we've recently bought in CVO, and had to obtain power of attorney for our solicitor out there. What we did was; Our solicitor in CVO sent a power of attorney form, that we then signed in front of our local solicitor (im manchester)(who is also a public nottary) he charged us approx £30. It was then sent by registered post to the foreign and commonwealth office in London for authorisation, we then sent it back to our solicitor in CVO

We don't live anywhere near London so it was easier to do everything by post. One word of warning though, when the form is signed at the foreign office in London, check that they have included a document number, about 10 digits, and not just put a seal on it, they missed it out on ours and the portugese consulate in portugal sent it back and we had to go through the whole thing again. On the whole the foreign and commonwealth office in london are very helpful and it doesn't take too long, about 7 days.
